NFA Transfers
Can I buy a suppressor in Indiana on a 4473 now?
Updated October 19, 2026: Wulfy’s Armory in Avon, Indiana now transfers suppressors, SBRs, SBSs, and AOWs the same way you buy any firearm: an ATF Form 4473 and a background check through an FFL, as long as your state allows it. This follows ATF’s October 9, 2026 open letter, which says ATF “will no longer require individuals to seek ATF approval under the NFA before making or transferring short‑barreled rifles, short‑barreled shotguns, silencers, and ‘any other weapon[s]’” and will “no longer require such items to be registered in the National Firearms Registration and Transfer Record.” ATF says this applies “uniformly to anyone otherwise subject to these requirements, not just to the plaintiffs in the litigation.” Machine guns and destructive devices are not covered. Prohibited persons still can’t have any of these items, and state and local laws still apply, so check yours before you buy or travel. ATF’s FAQ has the details.
| Before October 9, 2026 | Since October 9, 2026 | |
|---|---|---|
| Buying a suppressor, SBR, SBS, or AOW from an FFL | An approved ATF Form 4 before the transfer | An ATF Form 4473 and a background check through the FFL, where state and local law allow |
| Making one yourself | An approved ATF Form 1 before making it | No ATF approval required, where state and local law allow |
| Federal NFA registration | Required | Not required. ATF still accepts Forms 1, 3, and 4 from anyone who chooses to file |
| Taking an SBR or SBS across state lines | File a Form 20 | File a Form 20, same as before |
For SBRs and SBSs, ATF’s letter says it “is working as quickly as possible to issue new regulations to authorize federal firearms licensees to transfer short‑barreled rifles and short‑barreled shotguns under the GCA,” and “[i]n the interim, ATF will not enforce the provisions in 18 U.S.C. § 922(b)(4).”
What this does not cover
- Machine guns and destructive devices. ATF says “all NFA provisions still apply to machineguns and destructive devices.”
- Prohibited persons. These items are still “firearms” under the Gun Control Act and “may not be possessed by prohibited persons.”
- State and local law. ATF’s guidance doesn’t change it. Some states ban these items or only allow registered ones.
- Items with an obliterated serial number, or items that were illegally imported. ATF’s FAQ keeps those prohibitions in place.
- A permanent change. This is ATF enforcement policy, not a new law. ATF’s FAQ says enforcement could resume if, for example, “Congress could impose a new tax on NFA firearms, the district court’s injunction could be dissolved or overturned, or the Department could rescind the enforcement guidelines.”
This is a plain‑language summary of ATF’s letter and FAQ, not legal advice.
